Terms of Service for New Metro Transportation LLC

These Terms and Conditions (“Agreement”) govern the use of the website and services provided by New Metro Transportation LLC (“Company,” “we,” “us,” or “our”). By accessing or using our website or renting a vehicle from us, you (“Customer,” “you,” or “your”) agree to comply with these Terms and Conditions. Please read them carefully before making a reservation or using our services.

1. Eligibility

By booking a vehicle with New Metro Transportation LLC, you agree to the terms outlined in this Agreement. This Agreement governs the rental of vehicles provided by New Metro Transportation LLC, including the following:

  • Minimum Age: You must be at least 25 years of age to rent a vehicle. You must have a valid driver’s license and a credit card in your name for payment.

  • Driver’s License: The renter must present a valid driver’s license at the time of rental. An international driver’s permit may be required for non-U.S. residents.

  • Authorized Drivers: Only those listed on the rental agreement as authorized drivers may operate the vehicle. Additional drivers may be added to the agreement for an additional fee.Possess a valid, unrestricted U.S. driver's license (or valid foreign license with international driving permit).

  • Rideshare Account (If Applicable): Maintain an active and approved rideshare driver account with a recognized Transportation Network Company (TNC) such as Uber or Lyft.

  • Driving Record:

    • Have a clean driving record with no more than two (2) moving violations in the past three (3) years.

    • No DUI/DWI convictions within the past seven (7) years.

  • Background Check: Pass a background and driving record check conducted by New Metro Transportation LLC or its designated provider.

  • Insurance: Provide proof of valid personal auto insurance, if applicable.

New Metro Transportation LLC reserves the right to deny rental to any individual who does not meet these requirements or who we reasonably believe poses a risk to the safety of the vehicle, themselves, or the public.

2. Rental Agreement

All vehicle rentals are governed by both these Terms and a separate Rental Agreement specific to your vehicle and rental period. In the event of a conflict between these Terms and the Rental Agreement, the Rental Agreement shall prevail.

  • Rideshare Rentals: 7- Day Minimum. Billed weekly. Auto-renews unless cancelled with 48 hours notice.

  • Personal Rentals: 2- Day Minimum. Flexible short-term rental with a minimum two (2) day commitment.

Rideshare Renewals are automatic unless either party provides written notice of termination at least forty-eight (48) hours before the end of the current rental period.

3. Reservation, Payment, and Cancellations

  • Reservations: To secure a rental, a valid reservation must be made through our website or customer service team. Reservations are not confirmed until a booking confirmation email is sent.

  • Payment: Full payment for the rental is due at the time of booking. We accept payment by credit card, debit card, or other accepted payment methods.

  • Security Deposit: A fully refundable security deposit is required at the commencement of the rental period. The deposit amount is determined by the rental type and vehicle as specified in your Rental Agreement. Deposits will be refunded within fourteen (14) business days following the return and full inspection of the vehicle, minus any deductions for:

    • Damage beyond normal wear and tear.

    • Outstanding rental fees or charges.

    • Smoking or cleaning fees ($150 each).

    • Missing equipment, accessories, or property belonging to New Metro Transportation LLC.

    • Unpaid traffic citations, parking tickets, or toll violations.

    • Excess mileage charges.

New Metro Transportation LLC will provide an itemized statement of any deductions from the security deposit.

  • Cancellations and Refunds:

    • Cancellations made within 5 days of the scheduled rental start time may be subject to a full refund. cancellation fee.

    • Cancellations made after this period may result in a 75% refund for the remaining days.

    • Refunds are provided in accordance with our cancellation policy and will be credited to the original payment method.

4. Rental Period and Late Returns

  • Rental Period: The rental period begins at the time specified in the rental agreement and ends when the vehicle is returned.

  • Late Returns: If the vehicle is returned later than the agreed-upon return time, additional charges may apply. Late fees are charged at a rate of 125% per day, plus a $50 improper return fee, and a $20 inconvenience fee.

  • Early Returns: If you return the vehicle earlier than the agreed rental period, no refunds will be given for unused rental days.

5. Vehicle Use

  • Vehicle Restrictions: The vehicle must be used in accordance with the rental agreement. The following actions are prohibited:

    • Driving under the influence of alcohol or drugs.

    • Off-road use or use on unpaved roads, unless specifically approved by us.

    • Subletting or allowing others to drive the vehicle without prior approval.

    • Use of the vehicle for illegal purposes or in violation of local traffic laws.

    • Towing or pushing any other vehicle or object.

    • Transporting hazardous materials or illegal substances.

    • Use by any person other than the authorized Renter(s).

    • Racing, speed testing, or reckless driving.

  • Mileage: A standard mileage limit is applied to each rental. Additional charges may apply if the mileage limit is exceeded. Please refer to your rental agreement for specific mileage terms.

  • Fuel: The vehicle is provided with a full tank of gas. You must return the vehicle with a full tank. If the vehicle is not returned with a full tank, you will be charged for the fuel plus a $30 refueling fee.

  • Tollpass: A Tollpass convenience charge (“TCC”) (where available) of up to $5.00 per day of Rental Period for each day Vehicle is operated on a tollpass automatic service covered road and Vehicle operator does not pay an applicable toll. Total TCC charges will not exceed $25.00 per Rental Period. To avoid the TCC, Renter may (i) use toll-free roads and bridges, or (ii) pay tolls with cash (where applicable), which vary by toll road/bridge.

  • Prohibited Conduct:

    • No Smoking.Smoking, vaping, or e-cigarettes of any kind are strictly prohibited inside all vehicles. Violation results in a mandatory $250 cleaning fee, charged immediately.

    • No pets. No animals or pets of any kind are permitted inside the vehicle. Violation results in a mandatory $250 cleaning fee, charged immediately.

    • Operating the vehicle under the influence of alcohol, drugs, or any impairing substance.

    • Allowing unauthorized persons to drive the vehicle.

    • Removing, disabling, or tampering with any GPS tracking device or telematics equipment installed in the vehicle.

    • Using the vehicle for any purpose that violates local, state, or federal law.

6. Vehicle Maintenance & Condition

New Metro Transportation LLC Responsibility: New Metro Transportation LLC is responsible for all scheduled maintenance on rental vehicles, including oil changes, tire rotations, and routine mechanical servicing. Renters must not arrange or perform any maintenance or repairs on the vehicle independently without prior written approval.

Driver Damage: Any damage to the vehicle resulting from driver negligence, misuse, or prohibited conduct is the sole financial responsibility of the Renter and is not covered by New Metro Transportation LLC.

Rideshare Rentals: 1,500 miles/per week. Unlimited rideshare miles up to the weekly cap. Overage miles are charged per mile as specified in your agreement.

Personal Rentals: 150 miles per/day. Daily mileage limit as specified in your Rental Agreement. Exceeding this limit will result in additional per-mile charges.

Renter Obligations: You are responsible for the following during your rental period:

  • Maintaining proper tire pressure and checking fluid levels.

  • Keeping the vehicle clean and in good condition, interior and exterior.

  • Promptly reporting any mechanical issues, warning lights, or damage to New Metro Transportation LLC.

  • Not making any modifications, alterations, or unauthorized repairs to the vehicle.

  • Returning the vehicle in substantially the same condition as received.

7. Termination & Vehicle Recovery

Voluntary Termination: Either party may terminate the rental agreement by providing at least forty-eight (48) hours written notice before the end of the current rental period.

There is no grace period for late payments. If rental payment is not received within 24 hours of the due date, New Metro Transportation LLC reserves the right to immediately disable and/or repossess the vehicle without further notice.

New Metro Transportation LLC reserves the right to immediately terminate the rental agreement and recover the vehicle under the following circumstances:

  • Non-payment of rental fees within 24 hours of the due date.

  • Violation of any material term of this agreement.

  • Discovery of false or misleading information in your application.

  • Operating the vehicle outside the State of Alabama.

  • Any conduct that, in our sole judgment, poses a risk to the safety of the vehicle or the public.

New Metro Transportation LLC may utilize GPS tracking and other lawful means to locate and recover vehicles at any time. You agree to cooperate fully with any vehicle recovery effort and to return the vehicle promptly upon request.

Unless prohibited by law Renter shall pay Owner, its affiliates or agents:

  • If Renter returns or abandons the vehicle to a location other than the designated return location a vehicle recovery fee, unscheduled one way fee or drop charge which shall be a retrieval fee will be applied as follows: $130 for the first 5 miles, plus $6 per mile thereafter. This fee will be charged to the Renter’s account or deducted from the security deposit

8. Insurance and Liability

  • Insurance:

    • Personal Insurance: Renters may use their own personal auto insurance, provided the policy explicitly covers the full cost and full rental amount of a rental vehicle. You must provide proof of qualifying coverage prior to vehicle pickup. Your personal car insurance policy or credit card may provide coverage for rental vehicles. It is your responsibility to verify and understand your personal coverage. New Metro Transportation LLC reserves the right to reject coverage that does not meet our minimum requirements.

    • Episodic Insurance through New Metro Transportation: Insurance coverage options are available for purchase at the time of rental. Basic coverage may be included, but you are encouraged to purchase additional coverage for protection against damage, theft, or accidents.

  • Damage to Vehicle: You are responsible for any damage to the vehicle during the rental period. You must report any accidents, theft, or damage to us immediately.

  • Liability: The renter is liable for any damage to the vehicle, third-party property, or injury to any person resulting from negligence, improper use, or failure to adhere to the terms of this Agreement.

  • Incident Reporting: You must report any accident, damage, theft, or incident involving the rented vehicle to New Metro Transportation LLC within twenty-four (24) hours of its occurrence. You must also file a police report for any accident involving bodily injury, property damage exceeding $500, or vehicle theft.

9. Vehicle Return

  • Return Location: The vehicle must be returned to the location specified in your rental agreement. If you return the vehicle to a different location, an additional fee may apply.

  • Condition of Vehicle: The vehicle must be returned in the same condition as it was rented, with no additional damage or excessive wear. A cleaning fee may be charged if the vehicle is excessively dirty or requires special cleaning.

  • Inspection: A New Metro Transportation LLC representative will inspect the vehicle upon return to confirm its condition. Any discrepancies in condition will be noted, and the renter may be charged for repairs or cleaning as necessary.

10. Privacy and Data Usage

We collect and process personal information in accordance with our Privacy Policy. By agreeing to these Terms and Conditions, you acknowledge that you have read and understand our privacy practices.

11. Indemnification

You agree to indemnify, defend, and hold harmless New Metro Transportation LLC, its affiliates, employees, and agents from any and all claims, liabilities, damages, costs, and expenses (including attorney fees) arising out of:

  • Your use of the rental vehicle.

  • Any violation of this Agreement or any applicable law or regulation.

  • Damage to property or injury to persons arising from your actions during the rental period.

12. Governing Law and Dispute Resolution

  • Governing Law: This Agreement will be governed by and construed in accordance with the laws of the state of Alabama.

  • Dispute Resolution: Any dispute, claim, or controversy arising out of or relating to this Agreement will be resolved through binding arbitration, rather than in court, in Birmingham, Alabama. If arbitration is not enforceable, disputes will be resolved in a court of competent jurisdiction in Jefferson County, Alabama.

13. Limitation of Liability

To the maximum extent permitted by law, New Metro Transportation LLC is not liable for:

  • Any indirect, incidental, or consequential damages arising from your rental of the vehicle.

  • Loss of use, loss of profits, or any other financial loss.

  • Damages resulting from your use of the vehicle, including third-party claims or accidents.

14. Modifications and Updates

We reserve the right to modify, amend, or update these Terms and Conditions at any time. When we do, we will post the revised terms on our website with an updated effective date. It is your responsibility to review these terms periodically.
